Terms of Use
These Terms of Use (“Terms”) govern your use of the Nitya application and website (“Service”) provided by Nitya (“we,” “our,” or “us”). By downloading, installing, or using Nitya you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Nitya. By using the Service you represent that you meet this age requirement.
2. Your account
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must provide accurate information when creating your account.
- You must notify us immediately at hello@heynitya.com if you become aware of any unauthorised use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Upload, transmit, or store content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Attempt to gain unauthorised access to our systems or other users’ accounts.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent.
- Reverse engineer, decompile, or disassemble any part of the Service.
4. AI-generated content
Nitya uses large language models to generate responses and suggestions. AI-generated content:
- May not always be accurate, complete, or appropriate for your situation.
- Should not be relied upon as a substitute for professional advice (legal, medical, financial, etc.).
- Is provided “as is” without warranty of any kind.
You are responsible for verifying the accuracy of AI-generated content before acting on it. For important matters such as health, finance, law, travel, deadlines, or emergencies, verify information independently.
5. Voice features
If you use voice features, Nitya may process your voice input to convert speech into text and provide assistant responses. Voice features are used only to deliver the requested app functionality. Voice recognition may not always be accurate — please review important details before relying on them.
6. Reminders and notifications
Nitya may send reminders, push notifications, voice alerts, and follow-up notifications based on your saved reminders and app settings. Reminder delivery may depend on your internet connection, device settings, operating system restrictions, battery settings, and third-party notification services. You remain responsible for important deadlines and tasks.
7. Connected services
If you connect a third-party service (such as Google Calendar), you authorise Nitya to access that service on your behalf within the permissions you have granted. You can revoke this access at any time from the app Settings screen. Your use of connected services is also subject to those services’ own terms and privacy policies.
8. Intellectual property
The Nitya application, its design, code, and brand elements are owned by us and are protected by applicable intellectual property laws. These Terms do not grant you any rights in our intellectual property beyond the limited right to use the Service as described herein.
You retain ownership of the content you create using Nitya (your reminders, tasks, and notes). You grant us a limited licence to store and process that content solely for the purpose of providing the Service to you.
9. Service availability
We aim to keep Nitya available at all times but do not guarantee uninterrupted access. The app may be unavailable due to maintenance, updates, technical issues, network problems, or third-party service disruptions. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
10. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, missed reminders, missed deadlines, business loss, or reliance on AI-generated content.
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms or your use of the Service.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify you via email or in-app notice. Continued use of the Service after the effective date of updated Terms constitutes your acceptance.
14. Governing law
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be resolved in good faith between the parties before proceeding to formal dispute resolution.
